Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RetailBiz website and hosted retail business management platform ("Service") operated by RetailBiz ("we", "us", "our"). By accessing or using the Service, you agree to these Terms.
Use of service
RetailBiz provides a cloud-hosted software platform for retail businesses to manage sales, stock, customers, staff, expenses, debt and reports. You may use the Service only for lawful business purposes and in accordance with these Terms.
We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for the duration of your active subscription, subject to your plan's user limits and feature entitlements.
Account responsibility
You are responsible for:
- Providing accurate business and contact information during registration
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account and staff user accounts
- Configuring appropriate staff roles and permissions
- Notifying us promptly of any unauthorised access or security breach
You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.
Subscription and payments
Access to the RetailBiz application requires an active paid subscription (Starter, Growth or Pro plan, or as otherwise agreed). Subscription fees are billed monthly or annually as agreed during onboarding.
- Fees are due in advance for each billing period
- Failure to pay may result in suspension of access after reasonable notice
- Plan upgrades take effect immediately; downgrades take effect at the next billing cycle
- Refunds are handled on a case-by-case basis unless otherwise required by applicable law
Pricing displayed on our website is indicative. Final subscription terms are confirmed during the sales and onboarding process.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to store illegal content
- Attempt to gain unauthorised access to other tenants' data or our infrastructure
- Reverse engineer, decompile or attempt to extract the source code of the Service
- Interfere with or disrupt the Service or servers connected to it
- Share account credentials outside your authorised staff members
- Use automated tools to scrape or extract data beyond normal export features
We reserve the right to suspend or terminate accounts that violate these rules.
Data responsibility
You retain ownership of all business data you enter into RetailBiz. You are responsible for the accuracy and legality of data entered by you and your staff, including customer information, sales records and financial data.
We process your data as described in our Privacy Policy. You are responsible for ensuring you have appropriate consent to store customer and staff personal data within the platform, where required by applicable law.
We recommend regular use of the data export feature to maintain your own backups of critical business records.
Service availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, updates and unforeseen technical issues may cause temporary downtime. We will endeavour to provide advance notice of planned maintenance where possible.
The Service is provided on an "as is" and "as available" basis. Features may be added, modified or removed as the product evolves. We will communicate significant changes to active subscribers.
Intellectual property
RetailBiz, including its software, design, branding and documentation, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos or brand assets except as necessary to use the Service.
Limitation of liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service
- We are not liable for loss of profits, revenue, data or business opportunities
- Our total liability for any claim arising from these Terms or the Service is limited to the fees you paid us in the twelve (12) months preceding the claim
Profit estimates and reports generated by RetailBiz are indicative calculations based on data you provide. They do not constitute financial, tax or legal advice. You should consult qualified professionals for official financial reporting.
Termination
Either party may terminate the subscription:
- By you: By providing written notice before your next billing date. Access continues until the end of the current paid period.
- By us: For non-payment, violation of these Terms, or if required by law, with reasonable notice where practicable.
Upon termination, you may request export of your business data within thirty (30) days. After this period, we may delete your data in accordance with our data retention policy.
Governing law
These Terms are governed by the laws of the Republic of Ghana, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Ghana, unless otherwise required by mandatory applicable law.
Changes to terms
We may update these Terms from time to time. Material changes will be communicated to active subscribers via email or in-app notification at least fourteen (14) days before taking effect. Continued use of the Service after changes constitutes acceptance.
